The Court of Appeal dismissed Eddie Barnaville’s appeal against the severity of his sentence for two robberies on 1 November 2018. Mr Justice Edwards delivered the judgment, which held that the gravity of the offences had been correctly assessed and mitigation adequately reflected.
Barnaville pleaded guilty to two counts of robbery at Nenagh Circuit Criminal Court on 28 April 2017. A full-facts sentencing hearing took place the same day. A nolle prosequi was entered on a separate count of assault causing harm.
He was subsequently sentenced to two consecutive five-year prison terms, with the final four years of the combined 10-year sentence suspended. The suspension was conditional on a €100 bond, keeping the peace and being of good behaviour, and engaging with the Probation Services for two years and complying with its relevant requests.
The robberies occurred in Thurles on 24 and 25 January 2016. Barnaville argued on appeal that the sentencing judge had assessed their seriousness too highly and had given insufficient weight to mitigation, his early guilty plea and his rehabilitation efforts.
