DK and MK remained acquitted of false imprisonment after the Court of Appeal refused a retrial application on 9 February 2021.
They had been found not guilty by direction at the Circuit Criminal Court in Limerick on 13 November 2018, after a six-day trial.
The appeal court identified an error in directing the acquittals, but held that a third trial would not serve the interests of justice.
It cited the delay since the alleged events, the first respondent’s intervening conviction, circumstances affecting the second respondent and the alleged victim’s refusal to give evidence.
