Deryn Mackay’s dispute over a Blackrock commercial property was admitted to the fast-track Commercial Court list. The proceedings were reported on 15 October 2018. The dispute concerns premises at 13-15 Rockhill, Main Street, which Cheldon Property Finance DAC and receiver Ken Tyrell want to sell.
Cheldon claims €2.5m is due from Mackay, while she says a binding agreement requires it to accept €800,000 to settle her debts and release the mortgage. Cheldon denies that there is a binding agreement.
In September 2018, Mackay obtained a temporary ex parte injunction restraining Cheldon and the receiver from selling the property. Mr Justice Robert Haughton admitted the case to the Commercial Court list without objection and adjourned it to a date in November.
