Denis Nolan’s rape conviction upheld by Court of Appeal

By Saoirse Doyle

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Denis Nolan’s convictions for oral rape, defilement and sexual assault were upheld by the Court of Appeal on 31 July 2018. He had received an eight-year sentence at the Central Criminal Court on 15 May 2017 for abusing a boy at his home in Co Wicklow.

The appeal challenged the trial judge’s decision not to give the jury a corroboration warning. The three-judge court dismissed the appeal, finding no incorrect legal basis for that decision.

Nolan had denied the charges. The court was told the abuse occurred between 2005 and 2006, when the boy was aged between 10 and 11.
