Deirdre Foley loses challenge to Clerys investigation

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Deirdre Foley lost her High Court challenge to a Clerys redundancies investigation on 25 October 2016, with the court refusing the relief sought.

The case concerned inspectors’ entry into premises linked to D2 Private Limited and their seizure of materials while investigating possible offences connected with the redundancies.

Mr Justice Twomey held that intervention was premature because the investigation was at an initial stage and no criminal trial had begun.

The judgment said questions about the legality of the investigation and privileged documents should be addressed at trial, if proceedings later resulted, rather than through judicial review.
