Dean Caffrey was sentenced at the Central Criminal Court on 10 April 2025 to nine years in prison, with the final year suspended, for the manslaughter of Sean McCarthy.
Caffrey entered into bonds to keep the peace and comply with probation conditions upon his release after the active part of the sentence.
Caffrey pleaded not guilty to murdering McCarthy. A jury acquitted him of murder but convicted him of manslaughter by a 10–2 majority. The verdict was reported on 16 December 2024.
McCarthy, 28, died from a gunshot wound to the head in Caffrey’s Drumcondra apartment on 2 August 2022. Caffrey told gardaí that McCarthy had arrived with a gun, accused him of stealing heroin and threatened him over €5,000. He said he lunged for the gun when McCarthy was distracted and that it went off during a struggle. The jury was asked to consider whether Caffrey acted in self-defence and used reasonable force.
Caffrey took money from McCarthy’s pocket to buy cocaine and later bought a suitcase. He placed the body partially inside it in a wardrobe. Four days after the killing, he went to Ashbourne Garda Station and told gardaí where to find the body.
Passing sentence, Mr Justice Paul McDermott said Caffrey’s actions after the killing were an attempt to cover it up. He cited the failure to seek medical assistance, the taking of McCarthy’s money and phone, and the disposal of the weapon among the aggravating factors. He considered Caffrey’s offer to plead guilty to manslaughter and his genuine remorse as mitigating factors.
After sentencing, a spokesperson for McCarthy’s family said the family was disappointed and called on the Director of Public Prosecutions to appeal the sentence as unduly lenient.
