David Johnstone brought a High Court challenge to compel Dún Laoghaire-Rathdown County Council to assess his suitability for social housing, reported on 29 April 2024. He says the council has not identified the support he needs or completed an assessment compliant with the 2009 Housing Act.

Justice Niamh Hyland granted him permission to bring the judicial review challenge. Johnstone seeks an order requiring the council to complete the assessment, along with declarations concerning the council’s and State respondents’ duties.
