David Gibney’s complaints alleging workplace penalisation and unlawful pay deductions were adjourned by the Workplace Relations Commission on 14 November 2023.
The complaints concern alleged breaches of the Protected Disclosures Act 2014, the Employees (Provision of Information and Consultation) Act 2014 and the Payment of Wages Act 1994. Mandate argued that the claims were out of time and that Gibney lacked standing to bring one of them. The union’s preliminary objections are to be addressed through submissions; Gibney’s solicitor said oral evidence would be needed on the standing issue.
The adjudicator gave each side six weeks to file submissions and adjourned the case.
