David Gibney claims penalisation and unlawful pay deductions

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

David Gibney, the Mandate trade union’s press officer, brought complaints against the union alleging penalisation and unlawful pay deductions. The proceedings were reported on 14 November 2023.

His complaints alleged penalisation in breach of the Protected Disclosures Act 2014 and the Employees (Provision of Information and Consultation) Act 2014. He also alleged a breach of the Payment of Wages Act 1994.

At a preliminary Workplace Relations Commission hearing on 14 November 2023, Mandate argued that the complaints were out of time and that Mr Gibney lacked legal standing to bring the Employees Act penalisation claim.

His solicitor, Andrew Turner, agreed to deal with the time-limit arguments in legal submissions but said the question of legal standing required oral evidence. Adjudicator Jim Dolan gave each party six weeks to make submissions on the preliminary matters and adjourned the case.

This report covers an earlier stage of the case. Later developments are not reported here.
