The Workplace Relations Commission awarded builder David Donohoe €9,000 for unfair dismissal after his complaint against SJK Civils Ltd under the Unfair Dismissals Act 1977. The proceedings were reported on 28 May 2025.
Donohoe said a dispute about working hours on 5 April 2024 ended with him being told to go home and not return. The company director maintained he had only been sent away that day and was dismissed on 19 April. Adjudication officer Anne McElduff found both parties contributed to the escalation, but said the company had not shown that the dismissal was fair, reasonable or proportionate or that fair procedures had been followed.
McElduff directed SJK Civils to pay the €9,000, which she considered just and equitable in all the circumstances.
