Paramedic Dave Lanigan challenged HSE deductions linked to a shift allowance at a Workplace Relations Commission hearing on 27 July 2022.
Lanigan said he returned to work on Covid-19 mobile testing in April 2020, after an injury had kept him from frontline ambulance duties.
He said he was initially rostered from 1pm to 11pm and considered the shift allowance part of his entitlement. The HSE argued the allowance applied only to regular shifts beginning before 8am or after noon.
Lanigan said the HSE notified him it would recover €4,944.31 in payments, and that he chose instalments of €50 per fortnight to avoid a lump-sum deduction.
The HSE denied breaching employment law. Its solicitor disputed the WRC’s jurisdiction over part of the complaint and argued that some claims were brought too late.
Adjudicating officer Maria Kelly BL closed the hearing to consider her decision, which the report said would issue to the parties later.
