Crean Solutions Ltd wins leave over allegedly fraudulent CRO filings

Crean Solutions Ltd, which trades as MicksGarage.com, obtained High Court leave concerning allegedly fraudulent filings with the Companies Registration Office (CRO). The proceedings were reported on 2 December 2015.
Stephen Dowling BL, for the company, told Mr Justice Paul Gilligan that the filings named a person unknown to the company as a director. Counsel said other filings purportedly removed an existing director and changed the company’s registered address. He said the filings appeared fraudulent because the company and its directors had nothing to do with them.
Counsel said it seemed to his client that an unknown third party was attempting to pass themselves off as the company. The company had also received an invoice for an item it had not purchased, he said. A complaint had been made to gardaí, who were investigating, counsel added.
Mr Justice Paul Gilligan granted leave to serve short notice of the company’s application on the Registrar of Companies. The company sought orders under the 2014 Companies Act directing removal of the filings. The judge noted the concerns of the company and its chief executive, Ciaran Crean, and returned the matter to a date later that month.
