Council’s stay application adjourned in flood relief case

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court adjourned Roscommon County Council’s application to lift a stay on its flood relief works. Friends of the Irish Environment opposed the application. The proceedings were reported on 14 January 2022.

On 14 January 2022, Mr Justice Garrett Simons continued the temporary prohibition on further work, following an undertaking from the council. The stay application was put back for two weeks so the State could make submissions and the parties could consider a recent judgment.

The dispute concerns a proposed 3km pipeline from Lough Funshinagh to Lough Ree. Friends of the Irish Environment seeks to quash the council’s approval, which it alleges was unlawful and breached EU environmental law.
