Convicted rapist awarded €10,000 by Supreme Court

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

A convicted rapist was awarded €10,000 compensation by the Supreme Court on 28 November 2018, including unpaid pension arrears. The applicant’s identity was withheld to protect his victim.

The court declared the law preventing prisoners from receiving the State contributory pension invalid and unconstitutional. The applicant had been convicted of 14 counts of rape and 60 counts of sexual assault against a family member.

The court said €7,500 of the compensation had already been paid on account. One judge disagreed on damages, finding the applicant had no entitlement because the provision was declared invalid only from 28 November 2018.
