Healthcare worker banned for three months after collision with motorcyclist

A healthcare assistant has been disqualified from driving for three months after admitting he caused a collision in which a motorcyclist was injured.
Heherson Marquez (53), of Vernon Avenue, Clontarf, Dublin 3, pleaded guilty at Tallaght District Court to careless driving at Larkfield Park, Kimmage, Dublin 6W, on 19 January 2023.
The court heard that Marquez had been parked on the road waiting to collect his 14-year-old child from school when he attempted a U-turn. His car struck a motorcyclist, who was thrown from his vehicle.
Judge Patricia McNamara heard it was believed that the victim suffered a broken leg, although this could not be confirmed in court.
Judge McNamara was also told the victim has not been in contact with gardaí since.
A defence solicitor told the court that Marquez, a healthcare assistant earning €300 a week, had no previous convictions and had written a letter of apology as part of a restorative justice process. He was described as genuinely remorseful and has continued to work since the incident.
Counsel urged the court not to disqualify Marquez, citing his difficulties working night shifts in a nursing home without access to a car.
Judge McNamara said the case could not be ignored given the collision and injury involved. She convicted Marquez, fined him €450 and imposed a three-month driving ban, to take effect immediately. He was given five months to pay the fine.
