Man accused of being abusive in A&E department

By Elaine Stenson, Courts News Ireland

A man accused of being verbally abusive towards people in the accident and emergency department of Tallaght University Hospital has been granted bail on condition that he does not attend the unit unless referred there by a doctor.

Filippo Sangermano (58), currently living at Watergate House Hostel, Usher’s Quay, Dublin 7, appeared before Judge Patricia McNamara at Tallaght District Court after being arrested on Tuesday morning. The court heard that gardaí had been called to the hospital, where Mr Sangermano was allegedly abusive and aggressive in the emergency department.

He was charged with a section 6 public order offence, contrary to the Criminal Justice (Public Order) Act.

Mr Sangermano, who is unemployed, told the court from the dock: “I don’t know how you do things in Ireland, but in the UK we are entitled to speak to a solicitor and I haven’t yet seen a social worker.”

Garda Ed Curley told the court there was no objection to bail provided Mr Sangermano stayed away from the A&E.

Defence counsel, Ciara Ní Ghabhann BL, opposed a blanket restriction, arguing her client should not be prevented from seeking emergency care.

Judge McNamara agreed, saying: “My concern is something could happen tomorrow and he may need to attend A&E if he is involved in an emergency and needs urgent medical treatment”.

On consent, Garda Curley accepted a modified condition that Mr Sangermano may only attend the A&E if referred there by a doctor.

Bail was granted on the defendant’s own bond of €200. Solicitor Niall O’Connor was assigned to represent him.

Judge McNamara adjourned the case for disclosure to a later date at Tallaght District Court.
