Clive Kavanagh’s three-year sentence, with the final 18 months suspended, for money laundering was upheld by the Court of Appeal on 27 January 2020. The original sentence was imposed at Naas Circuit Court on 4 July 2019.
The case involved €829,265 found in 17 plastic-wrapped bundles at Tougher’s Garage, Naas, on 1 September 2017. The court dismissed the Director of Public Prosecutions’ application, finding the sentence very lenient but not significantly outside the norm.
The Court of Appeal held that the sentencing judge had acted within his discretion by partially suspending the sentence to encourage rehabilitation.
