Bríd Smith and three TDs win judicial review leave

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Bríd Smith, Richard Boyd Barrett, Gino Kelly and Paul Murphy were granted leave to seek judicial review in the High Court on 6 November 2019. The case challenges the Ceann Comhairle’s refusal to allow their motion to amend Dáil Standing Order 179 to proceed. Mr Justice Garrett Simons refused interim relief, including any stay affecting Dáil business or the Ceann Comhairle. He said the application met the low threshold of an arguable case, but stressed that permission did not mean the TDs would succeed at a full hearing. The court directed that the case receive an expedited hearing.
