Brian Dooley was awarded €10,000 for unfair dismissal by the Workplace Relations Commission, reported on 3 May 2023. The case arose from Dublin Port, where Dooley was dismissed after allowing a lost truck driver to ride on the running board of a moving container handling machine.

The adjudicator found Dooley’s response to an unexpected situation put himself and others at risk. She also accepted that traffic guidance and notices at the terminal were deficient, and concluded the employer had not adequately weighed his 24 years of diligent service and involvement in developing safety procedures.

The award reflected losses after Dooley was out of work for six months and later took a lower-paid job. The adjudicator said five job applications during that period did not adequately mitigate those losses, reducing the redress to €10,000.
