Ben Gilroy restrained from arresting Start Mortgages personnel

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court granted a temporary injunction on 31 October 2019 preventing Ben Gilroy from arresting, restraining or assaulting Start Mortgages’ current or former officers, agents, lawyers or employees.

The order also restrained Gilroy from publishing or posting online information about the home addresses or property of Start’s current or former employees, officers and lawyers. The injunctions applied to anyone else with knowledge of the orders.

Start sought the orders over social media videos in which Gilroy alleged the company was involved in fraud and called for people working with it to be arrested. It was claimed that he was inciting people to form a mob and make citizens’ arrests in an attempt to intimidate and harass Start’s representatives. Start rejected his fraud allegations.

Justice Leonie Reynolds granted the injunction on an ex-parte basis and made the matter returnable to Friday’s court sitting. She noted that documents before the court recorded Gilroy’s acknowledgement that the Director of Public Prosecutions had stated there was no fraud case against Start concerning his complaints.
