Apple wins leave to challenge data complaint inquiry

By Tadhg O'Sullivan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Apple Distribution International Limited secured leave for a judicial review at the High Court on 25 November 2024, challenging the handling of a data complaint.

The challenge concerns the Data Protection Commissioner’s decision to continue an inquiry into a complaint by French digital rights group La Quadrature du Net before deciding whether a sample complainant was valid. The complaint alleged Apple’s personal data processing breached the General Data Protection Regulation; Apple denies that allegation.

Ms Justice Gearty also stayed further steps in the inquiry and adjourned the case to January, with costs reserved. The report describes leave and the stay, but no final decision on Apple’s challenge.
