This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Anthony Kennedy won an unfair dismissal claim at the Workplace Relations Commission in a decision dated 31 March 2022, after his dismissal from Total Tiles Ltd.

Kennedy had worked for the company, which traded as Italian Tile and Stone, since April 2016; his employment ended on 5 May 2020. The adjudication hearing took place on 16 November 2021.

Adjudication officer Jim Dolan found the company had followed no procedures before dismissing Kennedy: there was no disciplinary interview, right of representation or opportunity to appeal. He upheld the unfair dismissal complaint, but said Kennedy had presented no evidence at the hearing that he had made any effort to mitigate his loss.

The WRC ordered the company to pay four weeks’ compensation, amounting to €2,258.76. It also ordered €1,129.38 in lieu of two weeks’ notice, which the company accepted was due. The awards were to be paid within 42 days of the decision.
