Algerian national wins deportation appeal over torture risk

By Niamh Kearney

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An Algerian national won his deportation appeal in the Supreme Court in a judgment dated 27 July 2017, after arguing that removal could expose him to torture or inhuman or degrading treatment.

The court held that the Minister for Justice had to assess the risk under the non-refoulement principle and Article 3 of the European Convention on Human Rights before deporting him.

It ruled that the protection applied regardless of compelling national-security reasons for removal and required careful consideration of the information relevant to the country concerned.

The Supreme Court allowed the appeal and held that relevant legal material had to be considered when reviewing the deportation decision.
