Algerian man wins deportation reconsideration in Supreme Court

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An Algerian man won an order for the Minister for Justice to reconsider his deportation case in the Supreme Court. The proceedings were reported on 16 August 2017. The court remitted the matter for further consideration after finding that the Minister’s decision did not provide sufficient assurance that it followed a clear, reasoned path and was not flawed. The case concerned alleged links to Islamic terrorism and the man’s claim that removal to Algeria could breach Article 3 of the European Convention on Human Rights.

The man applied for asylum in Ireland after he had been convicted in absentia in Algeria of terrorism-related offences, according to the report. He was subsequently convicted of multiple terrorism offences in France. The Supreme Court stressed that remitting the matter did not mean the Minister’s decision was necessarily incorrect.
