The Workplace Relations Commission ordered Ur Insurances (Europe) Ltd, trading as Actual Insurances, to pay Alan Rooney €2,138.58 after an unlawful deduction from his final wages. The decision, by adjudicator David James Murphy, concerned a complaint under the Payment of Wages Act 1991 and was published on 26 March 2024.

The company had deducted €2,138.58 from Mr Rooney’s net salary after he resigned in February 2023, saying it was entitled to recover commission because of a deficit in his sales targets. Mr Rooney said commission was paid when he met targets and that later shortfalls did not amount to overpayment.

Following a hearing in June 2023, Mr Murphy found the final-month salary was properly payable and ordered the company to pay the withheld wages. He said there was no suggestion Mr Rooney had agreed to the deduction.
