Alan Kilmartin was sentenced to two years in prison for assault causing harm by the Court of Appeal, reported on 23 March 2015. He had pleaded guilty at Ennis Circuit Criminal Court to assaulting a woman at Acha Bhaile, Lahinch Road, Ennis, on 2 March 2012. The court found his wholly suspended three-year sentence unduly lenient.
Kilmartin had received the suspended sentence in November 2013. The Court of Appeal said mitigating features, including his guilty plea and psychiatric illness, did not outweigh the seriousness and impact of the attack. It also ordered the return of a €3,000 compensation offer because the victim did not want it.
