Alan Hynes and Noreen Hynes were entitled to a full High Court hearing of their former solicitors’ application for a €2.3 million judgment. The proceedings were reported on 14 October 2016.
Seamus Maguire and Company Solicitors sought summary judgment over an allegedly dishonoured cheque. The firm had acted for the couple in purchasing a site at Moongate, Clonard, County Wexford.
The firm indicated to the court that it would not resist the case going to a full hearing.
The defendants disputed the claim and disputed that the cheque was dishonoured. Lawyers for Noreen Hynes argued that the claim should be dismissed on grounds including that there was no evidence the cheque had been dishonoured.
Mr Justice Paul McDermott found the couple had raised an arguable defence, but was not satisfied they had established a basis for dismissing the solicitors’ claim.
