Ajaya insurance dispute over alleged infertility admitted to court

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Ajaya’s insurance dispute over alleged infertility was admitted to the Commercial Court on 22 July 2019. The thoroughbred stallion’s owners, Rathbarry Stallions Ltd, Saleh Homaizi and Imad Al Sagar, claim London-based insurers failed to pay under a policy covering infertility.

The owners say veterinary testing in 2018 found Ajaya permanently infertile and seek performance of the insurance contract, his fair market value and damages. The insurers allege policy conditions were not met, say material facts were not disclosed and deny that the horse is permanently infertile. The case was adjourned to October, with mediation hoped for.
