The Workplace Relations Commission upheld Aeron James’s complaints of unfair dismissal and failure to provide statutory notice against Dawn Meats Ireland Unlimited, trading as Dawn Meats. Adjudication officer Enda Murphy awarded him €10,000 for unfair dismissal and €2,566.62, equivalent to six weeks’ pay, for the notice complaint. The hearing took place on 25 November 2021, and the decision was dated 19 April 2022.

James was dismissed for gross misconduct on 7 May 2020 after the company investigated him while he was on certified sick leave. Dawn Meats maintained that the dismissal followed a thorough and fair process. His internal appeal was unsuccessful.

James said photographs taken covertly by a private investigator showed him doing chores on his farm from 7 to 9 April 2020. He said the tasks were menial and he had no option but to tend to his animals. The company’s regional HR manager considered the work more strenuous than James’s job, but said he did not obtain a medical assessment before dismissing him.

Murphy found the dismissal procedurally and substantively unfair. He found that James had not been properly informed of the allegations before the investigation, that the decision makers’ multiple roles raised concerns about impartiality, and that the company had given scant regard to his explanations and mitigating factors. He found dismissal disproportionate.
