A.C. remained not guilty of assault causing serious harm after the Court of Appeal’s judgment on 21 December 2020. The case concerned a Dundalk pub incident in which the prosecution alleged that A.C. struck another man with a bar stool.
A.C. had also faced a charge of assault causing harm at Dundalk Circuit Criminal Court in February 2018. The trial judge excluded a medical certificate because its author had not personally examined the injured party, leading to a directed verdict on the more serious charge.
The Court of Appeal held that the certificate was not inadmissible for that reason and allowed the DPP’s appeal on the legal question. The judgment did not overturn the not-guilty verdict.
