Outcome: Mr Justice Birmingham said the court would quash the original sentence and re-sentence Davy to eight years' imprisonment with the final two years suspended and marked the sentence as served. Mr Justice Edwards said that the re-sentencing judge made no reference to Davy's remorse, his mental health difficulties, his addiction nor the accused's progress in prison which Davy was "entitled to have taken into account" when being re-sentenced. "But none of these were even mentioned," said Mr Justice Edwards.

Outcome: Mr Dwyer said that Davy had lost "a number" of job opportunities due to the length of the nine-year sentence albeit with two years suspended. Mr Justice Edwards said that the re-sentencing judge made no reference to Davy's remorse, his mental health difficulties, his addiction nor the accused's progress in prison which Davy was "entitled to have taken into account" when being re-sentenced. "But none of these were even mentioned," said Mr Justice Edwards.
