A 43-year-old man serving a 30-year sentence for the kidnap and torture of Quinn Industrial Holdings director Kevin Lunney at Drumbrade, Ballinagh, County Cavan in September 2019 has appealed a High Court refusal to extend time for him to challenge his trial in the non-jury Special Criminal Court. The applicant, convicted of false imprisonment and causing serious harm under the Non-Fatal Offences Against the Person Act 1997, sought judicial review of the Director of Public Prosecutions' decision to prosecute him in that forum. His legal team acknowledged before the Court of Appeal that the underlying challenge would have failed on merit, but argued the applicant was entitled to pursue the case and that denying access to court breached constitutional rights. The State's counsel contended the matter was moot given a Supreme Court ruling that no duty attaches to the Oireachtas to continuously review the Special Criminal Court's necessity. Ms Justice Isobel Kennedy indicated the court would first determine the mootness issue before reserving judgement.
