A High Court challenge brought by a man previously jailed for illegal dumping has been adjourned for twelve months. The action, taken under planning and waste management legislation, sought to prevent a waste facility at Labbadish, Manorcunningham in Letterkenny, County Donegal from operating without proper authorisation. The facility is operated by companies John Caulderbank, trading as D&M Services, and D&M Environmental Services Ltd, trading as DM Waste, who opposed the application. Justice Miriam O'Regan adjourned the matter to permit the respondent firms time to regularise their planning position through applications to An Bord Pleanála and Donegal County Council. The judge noted the development had been unauthorised but found that enforcement action by the council had not proceeded as the operators had been attempting to address planning breaches since 2018. The judge characterised the applicant as a "notorious environmental polluter" in Donegal, questioning his motivations for the proceedings.
