Two years for man who sexually assaulted woman with special needs

A 59-year-old Mayo man has been sentenced to three years imprisonment, with the final year suspended, following his guilty plea to sexually assaulting a woman with intellectual disabilities at the Central Criminal Court. The offence occurred at his home on 13 March 2015. The victim, who attended special needs school with the man's son, was found by medical assessment to lack capacity to consent due to her cognitive functioning. In her victim impact statement, the woman described significant distress and ongoing anxiety. Mr Justice Michael White identified the assault's serious nature and the victim's vulnerability as aggravating factors. The judge noted exceptional mitigating circumstances, including the man's lack of previous convictions, genuine remorse, and his role as a caring parent to his own son with special needs. The suspended portion of the sentence is conditional on the man's participation in the Better Lives programme.
