A man from County Dublin has had his sentencing adjourned at the Special Criminal Court following a dispute over the facts of a firearms case. Eamon McNamee, aged 37, pleaded guilty to possession of a firearm with intent to commit an indictable offence, namely assault causing harm, at Fairgreen in Saggart on 19 January 2013. The prosecution alleges McNamee shot and wounded a man during an operation targeting unlawful IRA activity in Dublin. Evidence presented included gunshot residue analysis and testimony from a detective sergeant. However, the defence has suggested multiple individuals were present at the scene, questioning whether McNamee was the person who fired the shot. The court indicated a Newton hearing may be necessary to resolve the factual disagreement between the prosecution and defence. McNamee was remanded on continuing bail until 5 February to allow the defence to confirm whether such a hearing is required.
