A High Court challenge has been initiated by Highfield Solar Limited against An Bord Pleanála's refusal to approve a solar energy development near Killinick in County Wexford. The proposed Grahormick Solar Farm would occupy 90 hectares currently used for grazing and comprise ground-mounted photovoltaic panels, electrical substations, and associated infrastructure. Wexford County Council had refused permission in August 2016, a decision upheld by the planning board last month. The company contends the board acted without legal authority in refusing permission on grounds that a national strategy for solar developments had not yet been adopted, arguing no such provision exists in planning legislation. The applicant also claims the board's decision is inconsistent, citing its approval of solar projects elsewhere, including one in County Longford. The company seeks orders to set aside the refusal and declarations that the board failed to provide adequate reasons and acted ultra vires. Mr Justice Seamus Noonan granted permission to bring the proceedings on an ex-parte basis, with the matter returnable in May.
