Consensual sexual contact “not a blank cheque” to force sex on someone, trial jury told

A jury at the Central Criminal Court has been told that prior consensual sexual contact does not permit subsequent forced intercourse. The trial concerns a 22-year-old Donegal man charged with rape alleged to have occurred in an alleyway in Donegal Town in July 2012. The accused has pleaded not guilty. Prosecution counsel submitted that prior agreement to sexual contact did not constitute permission for further acts without consent, referencing established judicial guidance on such matters. Defence counsel argued the accused stopped immediately upon protest and questioned the prosecution's account of events. The jury of twelve was instructed to begin deliberations following the judge's address. The case remains before the court pending verdict.
