His counsel argued that the disciplinary process follows a pattern of alleged workplace harassment stemming from an earlier incident in which the garda arrested a colleague from a drugs unit, subsequently facing intensive managerial scrutiny. The garda claims his partner was unlawfully pressurised into providing a statement to gardaí, which she later retracted, and that the forwarding of this statement to the Garda Síochána Ombudsman Commission occurred without proper authorisation. Mr Justice Seamus Noonan granted permission to bring the action on an ex parte basis and imposed a stay on disciplinary proceedings pending judgment. The matter was adjourned to late January.
