Drunk driver who caused death of four-year-old boy has jail term cut on appeal

Outcome: O'Rourke brought a sentence appeal last week and in the Court of Appeal this morning he was re-sentenced to eight years imprisonment with the final two suspended. Mr Justice Mahon, who sat with Mr Justice George Birmingham and Mr Justice Garrett Sheehan re-sentenced O'Rourke to eight years imprisonment with the final two suspended.

Drunk driver who caused death of 4-year old boy sentenced as "example", appeal lawyers tell court

Plea: Guilty

Outcome: Judge Keenan Johnson sentenced O'Rourke to seven-and-a-half years imprisonment at Portlaoise Circuit Criminal Court on November 3, 2015. Mr Devally said O'Rourke "should be sentenced for what he did" but the view was that he had to be "seen as an example rather than an individual".
