Walsh claimed she was pregnant and that the dealership's management knew of her pregnancy after she informed her former line manager. The company had told her she was not expected to meet a target of 60 cars in the first quarter, a figure that applied to senior staff, and that she was in an apprenticeship role. An adjudicator found the management's defence uncredible, concluded the dealership had become aware of her pregnancy, and ruled that the dismissal was discriminatory under the Employment Equality Act 1998.
