Summary

Stephen Silver, a 46-year-old mechanic from Aughavard, Foxford, County Mayo, has pleaded not guilty to the capital murder of Garda Colm Horkan at Castlerea, County Roscommon on 17 June 2020. He has pleaded guilty to manslaughter. At the Central Criminal Court, the jury heard a video recording of Mr Silver's first interview with gardaĆ at Castlerea station. In the interview, Mr Silver stated that Garda Horkan initiated a struggle after approaching him on the street, and that the officer went for his gun after losing the ensuing confrontation. Mr Silver told detectives he was certain he would have been killed had he not gained control of the firearm, which he said discharged during the struggle. He said he was "a law-abiding citizen" unaware of the garda's identity. The prosecution presented evidence from Detective Inspector Brian Hanley regarding observations made during the interview. Detective Sergeant Eric Godfrey, who trained with Garda Horkan at Garda College in 1994, gave emotional testimony. The trial continues before Ms Justice Tara Burns and a jury of twelve.
