Silver, of Foxford, Co Mayo, was sentenced in April 2023 to life imprisonment with a minimum term of 40 years for murdering a Garda acting in the course of his duties. O'Reilly stated that Silver told gardaí in custody that he had been able to pull Horkan's pistol from the holster. The Commissioner of An Garda Síochána is named as a notice party in the proceedings.
