Summary

The Special Criminal Court heard submissions on the admissibility of mobile phone evidence in the trial of four men accused of falsely imprisoning and causing serious harm to Quinn Industrial Holdings director Kevin Lunney. Defence counsel Michael O'Higgins SC argued against the use of mobile phone data, following two days of garda testimony regarding how officers compiled records from numbers allegedly associated with three of the accused. The men charged are a 40-year-old who cannot be named by court order, Alan O'Brien, aged 40, of East Wall in Dublin, Darren Redmond, aged 27, also of East Wall, and Luke O'Reilly, aged 67, of Mullahoran Lower, Kilcogy, County Cavan. All have pleaded not guilty to false imprisonment and intentionally causing serious harm to Mr Lunney at Drumbrade, Ballinagh, County Cavan on 17 September 2019. The court previously heard evidence of the attack Mr Lunney sustained during the incident.
