Summary

Richard Joyce, 24, of Swans Nest, Kilbarrack, pleaded guilty to possession of stolen articles on 15 December 2016 in Portmarnock. He stole a TopCon surveying machine, worth €48,000, from a building site and was caught by gardaí while driving. The machine was recovered intact. Judge Sinéad Ní Chúlacháin sentenced Joyce to 18 months, fully suspended for the same period. The judge noted the offence was opportunistic, not pre‑meditated, and that Joyce had no idea of the machine's value. He had previously been convicted of possession of stolen items and failure to appear in court. The judge cited his turbulent childhood, PTSD, depression, anxiety and psychosis, and his history of addiction, as factors in the decision to suspend the sentence and encourage rehabilitation.
