Joseph Kiernan, aged 34, was deported from the Netherlands after serving a partially suspended three‑year robbery sentence. Kiernan was banned from driving for 20 years. He had 55 prior convictions, including robbery, vehicle theft, burglaries and possession of stolen property.

Dean Kelly BL, defending, submitted that Kiernan wasn't aware that a condition of the suspended portion of his Netherlands robbery sentence was that he leave that country for ten years.
