A boy born at Cavan General Hospital in August 2017 with cerebral palsy has received a €4.6 million interim payment following settlement of his High Court medical negligence claim against the HSE. The child, who requires constant care and monitoring due to seizures and respiratory difficulties, had sued through his mother over alleged failures in duty of care during delivery. The HSE previously conceded liability regarding breach of duty, though causation remained disputed and was due for hearing later in 2020. Following out-of-court negotiations, the parties reached resolution. The hospital and HSE issued an unreserved apology before the High Court on Wednesday, acknowledging the failings in care that caused the child's injuries and the ongoing distress experienced by his family. The interim payment will provide for the boy's continued medical care. The case will return before the court in June 2025. Mr Justice Kevin Cross approved the settlement and commended the family's dedication to the child's welfare.
