Youth sentenced for robbing phone from unconscious man

Summary

Lewis Smith, 19, of Tallaght, was sentenced to two and a half years in prison for robbing a mobile phone from an unconscious man at the Fortunestown City West Luas stop on 17 April 2015. Smith, who had 13 prior convictions, pleaded guilty to robbery. The victim, who was attacked while returning home from work, was tripped, fell onto the Luas tracks, and was then kicked and punched until unconscious. His €400 phone was taken while he lay on the ground. The victim spent three days in hospital with concussion and still suffers nerve pain. Smith's sentence includes a six‑month suspended portion and a 12‑month probation period with requirements for education, employment and drug treatment. The judge noted Smith had written an apology letter and that his cousin had died in a similar assault. The case was heard at Dublin Circuit Criminal Court.
