Jail for possessing gun with erased serial number
Summary
Daniel Kavanagh, aged 25, was sentenced to five years' imprisonment on 18 February 2016 for possessing a 9mm Makarov pistol, a silencer and three rounds of ammunition. He pleaded guilty at Dublin Circuit Criminal Court on 13 July 2015. The judge, Martin Nolan, held that Kavanagh must have known the weapons would be used to kill or injure, and that the most innocent explanation was that he was transporting the gun for others to use. Garda Alan Carbery testified that the firearm was found in a silver metal case inside a black bag in the footwell of a car in which Kavanagh was a passenger. Ballistic tests confirmed the gun and silencer were compatible and capable of firing the ammunition. The serial number on the gun had been deliberately erased. Kavanagh had nine prior convictions, including three for drug dealing. The driver of the car, an associate, pleaded guilty to related offences and will be sentenced next month.
