Pathologist could not distinguish between deliberate thrust of knife and "run-on" after examination

Summary

In a murder trial, the 46‑year‑old stepfather, David Mahon, is charged with killing his brother, Dean Fitzpatrick, 23, on 26 May 2013. The prosecution described the death as a 'gutting'. Pathologist Dr Michael Curtis testified that Dean Fitzpatrick died from a single stab wound to the abdomen, about 14.5 cm deep, that entered the abdominal aorta, small intestine and ended in the spine, causing massive haemorrhage. He said the wound required moderate or considerable force. When questioned about a possible 'run‑on' – where a person advances onto a knife held by another – he could not distinguish between a run‑on and a deliberate thrust. Dr Curtis also noted old scars on Dean's forearm that might indicate past self‑harm. Forensic scientist Dr Fiona Thornton found a jagged tear in Mahon's shirt and a hole in his jeans, consistent with a knife being placed in his back pocket.
