Dublin man becomes third to be convicted of 2009 gangland murder
Summary
A Dublin man, Gary Flynn, aged 31, was sentenced to life imprisonment for the 2009 murder of Seamus Shay O'Byrne in Tallaght. The trial lasted nine weeks, with the jury taking one hour and forty minutes to convict. Flynn pleaded not guilty. The judge, Mr Justice Patrick McCarthy, backdated the sentence to October 2013, the date of Flynn's arrest under a European Arrest Warrant. Flynn was not identified as the gunman; the shooter was identified as Garrett O'Brien, convicted in 2012. Evidence against Flynn included CCTV footage of him traveling with Eugene Cullen, a "Topaz Phone" linking him to the gang, and gunshot residue on a hoodie. The court heard a victim impact statement from O'Byrne's family and girlfriend, Sharon Rattigan, who was also shot during the incident. Flynn was taken to prison to begin his mandatory life term.
